Tests Confirming Page-Trowbridge Leaking Into Aquifer Disproves Claim By Robson Communities

      During October, Robson Communities claimed that the Page-Trowbridge landfill had no effect on the aquifer that runs beneath it.  The claim was published on a Robson web site and in a Robson edited newspaper.

       On October 16th, I requested that Robson Communities either substantiate their claim or rescind it (click HERE for story).

       On October 19th, James Polus, general manager of utilities for Robson Communities, and Karl Polen, senior vice president and chief financial officer for Robson Communities, responded by saying that it was their belief that Page-Trowbridge has no effect on the aquifer beneath it.

      The recent discovery of test results analyzing water samples from Monitoring Well #5 of the Page-Trowbridge radioactive/toxic waste landfill, confirms that the Page-Trowbridge radioactive/toxic waste landfill is leaking into groundwater.  These tests prove that the belief that Page-Trowbridge has no effect on the aquifer is false.

       The confirmation that Page-Trowbridge is leaking to groundwater also invalidates the Dames & Moore finding that "there is little or no possibility" that contaminants would ever reach the groundwater beneath Page-Trowbridge. 

       The engineering firm of Dames & Moore published this opinion in a report dated January 11.  Robson Communities, Inc. paid $30,000 to have Dames & Moore produce the report 

       Today, a letter was sent via Federal Express to Polus and Polen informing them that their belief is incorrect and requesting that they not present this false and misleading belief as a statement of fact, so as to avoid any perception that Robson Communities is attempting to mislead consumers.

       Additionally, it was requested that Robson Communities fully disclose that it is now a confirmed fact that Page-Trowbridge is leaking to the water supply to all potential buyers of homes in the proposed SaddleBrooke Ranch development, if and when it is built.

Dear Mr. Polus and Mr. Polen;

Thank you for your response. I note from your response that you believe the Page-Trowbridge radioactive/toxic waste landfill has no effect on the groundwater beneath it. 

Recently disclosed facts confirming the Page-Trowbridge landfill is leaking into the aquifer beneath it prove that this belief is incorrect.

Attached you will find copies of two test results showing analysis of two water samples taken from Monitoring Well #5 at Page-Trowbridge April 26, 2000 by University of Arizona Risk Management personnel. These samples were obtained following the standard sampling methodology approved by the Arizona Department of Environmental Quality (ADEQ). The samples were analyzed following the standard methodology approved by ADEQ. The test results confirm that toluene and 1,4 Dichlorobenzene have been detected in groundwater beneath Page-Trowbridge, providing clear evidence that Page-Trowbridge is leaking to groundwater. 

In light of the fact that Toluene and 1,4 Dichlorobenzene have been confirmed as present in the water taken from the monitoring wells of Page-Trowbridge, any statement to the effect that the Page-Trowbridge landfill has no effect on the aquifer beneath it is incorrect. 

It is my understanding that any representation of this incorrect belief as a statement of fact could be interpreted as an attempt to mislead consumers. Currently the Lago del Oro web site has a page presenting your incorrect belief stated as a fact; see item 9 on this page: http://www.lagodeloro.com/lagodeloro5.html. I have attached a copy of the page to this letter.

I again request that you remove this false and misleading claim from the Robson web site as well as retract the claim in any publication that originally carried the claim. 

Additionally, I request that Robson Communities disclose the fact the Page-Trowbridge radioactive/toxic waste landfill is leaking into the drinking water supply for SaddleBrooke Ranch in the Subdivision Public Report for SaddleBrooke Ranch; as I understand this disclosure to be required by state law.
